1. DEFINITIONS
GDPR - EU General Data
Protection Regulation (Regulation (EU) 2016/679 of the European
Parliament and of the Council of 27 April 2016 on the protection of
natural persons with regard to the processing of personal data and on
the free movement of such data, and repealing Directive
95/46/EC).
SERVICES means the service of selling
wine.
PERSONAL DATA / PERSONAL INFORMATION means any data
relating to an identified or identifiable living person.
CONTROLLER
means the natural or legal person who determines the purposes and
means of the processing of personal data and who is responsible for
the processing of such personal data in accordance with the GDPR and
other applicable European and Member State laws on the protection of
personal data.
PROCESSOR means the natural or legal person
who processes personal data on behalf of the
Controller.
SUB-PROCESSOR refers to a natural or legal
person who processes personal data on behalf of the Controller, as
specified in the contract and in accordance with our
instructions.
YOU refers to a natural person, whose
personal data is collected and processed by OPG Vina Deklić, vl.
David Deklić.
2. About OPG VINA DEKLIĆ, vl. DAVID
DEKLIĆ
We, OPG Vina Deklić, vl. David Deklić, are
responsible as the Controller for all personal data that you provide
to us in connection with the offer of our Services.
While
providing Services to our visitors and processing personal data, we
act as the Controller.
We act as the Controller in
situations where we process personal data for our own purposes and in
the manner described in this Privacy Notice.

COLLECTION, PROCESSING AND STORAGE OF PERSONAL DATA
Unless
otherwise agreed, we will only collect basic data necessary to
implement the offer of our Services or in connection with our
business relationship. In the case of the implementation of business
cooperation and business relationship, we will also collect data
related to business, which data may include information about
purchases, services and other business activities, feedback and any
other information that you can provide us, which information is
necessary to implement the business relationship.
We may
collect your personal data directly from you or indirectly for one of
the following reasons:
1. General inquiry via e-mail;

You have initiated communication with us via your social media
profile;
3. When you browse our website - a third-party
service (i.e. Google Analytics);
4. Links to other
websites.
We collect personal data depending on the
specific situation mentioned above. We only collect the necessary

3.1. General inquiry via e-mail - when you contact
us with a question about our services and when you are looking for
new business opportunities.
Personal data we collect:
name, e-mail, phone number, country and related data such as your
company name, job role, phone number.
Legal basis for data
collection: performance of the contract (GDPR article 6.1. (B),
legitimate interest according to GDPR article 6.1. (F) in terms of
providing our Services to you.
Data retention period:
unless we conclude a contract, we will delete your personal data
within 6 (six) months after our last communication. Also, based on
legitimate interest, if you no longer want us to contact you, you can
object by sending an email to info@vina-deklic.com

You have initiated communication with us through a social network
profile
Personal data that we can collect: first and last
name, e-mail, phone number.
Legal basis for data
collection: consent (Article 6.1 (A) GDPR, legitimate interest
according to Article 6.1 (F) GDPR.
Data retention period:
in the event that you have not used our Services, we will retain the
data based on legitimate interest until you object to the processing
of your personal data for this purpose or, in the event that you have
given your consent, until you withdraw your consent.

website - third party service (i.e. Google Analytics)
Personal
data we collect: we usually collect IP addresses, browser type, pages
you have visited and the order in which you visited them, as well as

In the case of data
transfer to the USA, consent will be required due to the consequences
of the ˝Schrems II˝ ruling and the invalidation of the Privacy
Shield.

responsible for the privacy practices of other websites. We encourage

view of the above, and the data controller uses tools and services of
social networks that do not operate in the territory of the European
Union, we are obliged to inform you that these third parties that
manage social networks can transfer your data to the USA where they
are shared with the intelligence services in accordance with the
regulations in force in the USA.
4. WHO
WE SHARE PERSONAL DATA WITH
We may share your personal
data with:
- third parties as Sub-Processors, if necessary
or permitted by applicable law;
- third parties as
Sub-Processors to provide specific functionalities such as targeted
marketing and other tools necessary to provide our Services (e.g.
Google Analytics, Covus, Lloyds digital d.o.o. which maintains the
website);
- third parties who are legally authorized to
process credit decisions, prevent fraud and prosecute debtors; and

third parties who are legally authorized to request access to and
share your personal data for the purpose of criminal proceedings or
threats to public safety.
Otherwise, no third party will
have access to your personal data unless there is a legal requirement
to do so or you give us permission to do so.
5. TRANSFER
OF PERSONAL DATA TO THIRD COUNTRIES
In view of the above,
we may share your personal data with third parties located outside
the European Economic Area, however, all transfers of personal data
are carried out in accordance with the EU GDPR data protection
standards.

RIGHTS
Under the EU General Data Protection Regulation,
you have the right to:
- The right to be informed about
the collection and use of your personal data is a key transparency
requirement under the GDPR;
- The right to access your
personal data, which means requesting a copy of the personal data we
hold about you;
- The right to have your personal data
rectified if it is incomplete or inaccurate;
- The right
to erasure (right to be forgotten) when your personal data is no
longer needed or when your personal data has been used unlawfully, in
accordance with your request for erasure;
- The right to
restrict the processing of your personal data in certain
circumstances as an alternative to the right to erasure of your
personal data;
- The right to data portability means that
we can obtain and reuse your personal data for our own purposes;

that will stop or prevent us from processing your personal data in
accordance with our legitimate interests, e.g. for direct marketing
purposes;
- Rights regarding automated decision-making and

above rights in accordance with the EU General Data Protection
Regulation and national data protection regulations.

RIGHT TO OBJECT TO THE USE OF YOUR DATA
You have the right
to object, i.e. the right to stop or prevent us from using your data
in certain circumstances, and we may not have to stop processing your
personal data if you give us compelling and legitimate reasons to
continue using your data.
You can only object to
processing when we use your data:
- For our legitimate
interests; and
- For direct marketing purposes.
In
cases where we rely on legitimate interest as the legal basis for
processing your data, you can object to such processing at any time.
In this case, we are obliged to prove to you
(1) that
there are compelling legitimate grounds for the processing of the
data by us or a third party, which override your interests, rights or
freedoms, or
(2) that the processing of the data is
necessary to establish, exercise or defend legal claims.
On
the other hand, in the case of direct marketing, we cannot refuse
your objection and we will stop using your data for direct marketing
purposes. You can exercise this right by unsubscribing.

HOW TO EXERCISE YOUR RIGHTS

the way we handle your personal data or wish to lodge a complaint
about the way we have handled your personal data, you can contact our

6.3. RIGHT TO LIE TO A SUPERVISORY
AUTHORITY
If you believe that we are processing your
personal data unlawfully, you have the right to lodge a complaint
with a supervisory authority for personal data protection. In the
Republic of Croatia, this authority is the Personal Data Protection
Agency (www.azop.hr).
If your habitual residence, place of
work or place of the alleged infringement is in another EU Member
State or if you consider that your rights have been violated in
another EU Member State, in any case, you may lodge a complaint with
the supervisory authority of that country.
8. AMENDMENTS
TO THIS PRIVACY NOTICE
This Privacy Notice was last
updated in November 2024. From time to time, you may wish to check
whether this Privacy Notice has changed or been amended in accordance
with applicable data protection rules.
